1. ELIGIBILITY AND ACCEPTANCE
Legal Capacity: You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
Binding Agreement: These Terms constitute a legally binding agreement between you (“User”, “you”) and Sigma Homes (“Company”, “we”, “us”).
2. SCOPE OF CONSULTANCY SERVICES
Sigma Homes acts as a professional real estate consultancy firm providing:
Strategic investment advice and market analysis.
Assistance in identifying residential and commercial properties.
Facilitation between buyers, sellers, and RERA-registered developers.
No Direct Sale: We are a consultancy and not the developer or owner of the properties listed unless explicitly stated. All transactions are ultimately governed by the Agreement for Sale between you and the respective developer or seller.
3. COMMUNICATION AND CONSENT
To Communicate with You: We may use your information to respond to your inquiries, provide customer service support, send you important information about the services, and send you marketing communications (with your consent) via different channels, including but not limited to:
SMS & RCS: Short Message Service and Rich Communication Services.
Email: Newsletters, property alerts, and transaction updates.
WhatsApp: Official business messaging for faster updates.
Voice: Automated or manual calls for service verification or project follow-ups.
Opt-out: You may withdraw your consent for marketing communications at any time by following the "unsubscribe" link in emails or replying "STOP" to SMS/WhatsApp messages.
4. RERA COMPLIANCE & DISCLAIMER
Verification: Users are strictly advised to verify the Real Estate Regulatory Authority (RERA) registration number of any project on the official state RERA website before making any financial commitment.
Informational Content: All layouts, plans, and specifications on our site are provided by third-party developers and are for representational purposes only. They do not constitute a legal offer.
Consultancy Limitation: While we facilitate property identification, we do not provide legal, tax, or accounting advice. Users should consult their own professional advisors for such matters.
5. RENTAL RULES (2026 UPDATES)
In accordance with the latest Model Tenancy Act standards implemented in 2026:
Mandatory Registration: All rental agreements must be registered with the relevant Rent Authority within 60 days of execution.
Security Deposits: Residential deposits are generally capped at two months' rent, and commercial deposits at six months' rent.
Digital Stamping: Physical stamp papers are largely obsolete; we recommend and facilitate digital stamping and registration via State Portals.
6. USER OBLIGATIONS
Accuracy: You agree to provide true and accurate information during inquiries.
Lawful Use: You shall not use the Site for data mining, unauthorized commercial use, or any activity that impacts website performance.
Due Diligence: It is your responsibility to inspect the physical condition of the property and verify title documents before concluding a purchase.
7. INTELLECTUAL PROPERTY
All content on sigmahomes.co.in, including brand names, logos, and proprietary data, is the exclusive property of Sigma Homes. Unauthorized reproduction, transmission, or commercialization is strictly prohibited.
8. LIMITATION OF LIABILITY
No Warranty: The Services are provided "as is" without any express or implied warranties.
Third-Party Acts: Sigma Homes shall not be liable for any loss, delay, or financial damage resulting from a developer’s failure to complete a project or a seller’s breach of contract.
Technical Errors: We are not responsible for errors in price listings or technical downtime.
9. INDEMNIFICATION
You agree to indemnify and hold Sigma Homes harmless from any claims, losses, or legal fees resulting from your breach of these Terms or your use of the Services in violation of applicable laws.
10. GOVERNING LAW & DISPUTE RESOLUTION
Jurisdiction: These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
Arbitration: Any disputes may be referred to a single arbitrator in accordance with the Arbitration and Conciliation Act, 1996.
11. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Continued use of the Site after such changes constitutes your acceptance of the updated Terms.
